Art. 1 - Object
The General Terms and Conditions of Sale govern the purchase of products remotely via the Internet through the website Carbonarm.com, owned by Easydive srl, with its registered and operational office at Via dell'Industria 13 int.6, Montaletto di Cervia (RA), VAT No: IT02665730392 - REA RA221658, Ravenna Business Register. All product prices are indicated with VAT included (where applicable) and without VAT, except for errors and/or omissions. Privacy protection complies with the provisions of Legislative Decree No. 196/2003 ('Privacy Code'). Before placing an order, the Customer must read the Privacy Policy available on the website www.carbonarm.com and consent to the processing of their data.
Art. 2 - Acceptance of General Terms and Conditions of Sale
The current General Terms and Conditions of Sale and the Privacy Policy must be read and accepted by customers of the website Carbonarm.com before placing an order. Without their acknowledgment and acceptance, the purchasing process cannot proceed. By placing an order, Customers declare that they have read and accepted all the specified terms and conditions of sale and payment, and declare that they have thoroughly read the Privacy Policy, are fully aware of its content, and give their consent to the processing of their data. By sending the purchase order, customers unconditionally accept these terms and agree to comply with them in full, including the payment method. Customers agree to print and retain these General Terms and Conditions of Sale at the end of the purchasing process, in accordance with Articles 52 and 53 of Legislative Decree No. 206/2005.
Art. 3 - Purchasing Procedure
Purchases of available products, as illustrated and described in the corresponding online technical sheets, are made by Customers at the indicated current price, including VAT (where applicable), plus shipping costs, which are always displayed during the purchase process. Carbonarm disclaims any responsibility for transcription errors in the technical sheets and/or for modifications and/or inaccuracies in the images and photos accompanying the technical sheets. Additionally, any accessories shown in the photos should be considered as optional extras available for purchase to complement the related product. The prices of the available products do not include transport costs. Before confirming the purchase, customers will see an order summary containing the product codes, the unit price of each chosen product, the total price per line, the total purchase cost, and any shipping charges. The sales prices on the website www.carbonarm.com may differ from those offered directly by the company or from other promotions reserved for events and/or special customers. After completing the purchase order and correctly finalizing the payment, customers will receive an order confirmation email. Upon receipt of the email, customers should verify the accuracy of the data and purchased products and, if necessary, report any errors and/or request information at info@carbonarm.com. If customers do not receive an order confirmation email, they can check the status of their order in their account under "Order History and Details." Please note that if the payment is unsuccessful, the order confirmation email will not be sent.
Art. 4 - Payment Methods
Payments on the website www.carbonarm.com can be made via Bank Transfer, Credit Card, or Cash on Delivery. Bank transfers must be made to the account held by Easydive srl at LA CASSA DI RISPARMIO DI RAVENNA, IBAN IT23W0627024000CC0190256135, within 5 working days from the date of order confirmation. If the transfer is not completed within this period, the contract will be automatically canceled. In any case, the products will be shipped only after Carbonarm has received the payment in its bank account. If a customer cancels an order paid by Bank Transfer or Credit Card, Carbonarm will issue a refund using the same payment method chosen by the customer. Customer data is transmitted using secure methods to prevent unauthorized access.
Art. 5 - Delivery
Carbonarm delivers its products worldwide. Shipping costs are borne by the customer, with shipping rates varying based on distance, order value, and the chosen service type. The purchased products will be delivered by Carbonarm to the address specified at the time of order. Deliveries will only be made on working days. Carbonarm is not responsible for errors in the provided address (such as the name on the doorbell, street name, building number, city, or country). To facilitate courier delivery, it is mandatory to provide a valid phone number for reference during delivery. The invoice (or receipt) will be included directly in the package and delivered to the customer. If an order contains products with different availability, Carbonarm reserves the right to deliver them in a single shipment when all items are available. Upon receipt, the customer must check that the number of packages delivered matches the invoice and that the packaging is intact and the product conforms to the order. If the package appears damaged upon delivery, the customer must accept it “with reservation.” Once the customer signs the delivery document without reservation, they can no longer object to the condition in which the package was delivered.
Art. 6 - Right of Withdrawal
The right of withdrawal for products purchased through our online store is governed by Articles 64 and following of Legislative Decree No. 205/2006 ('Consumer Code'). The decision to exercise the right of withdrawal must be communicated by the customer via registered letter with acknowledgment of receipt within 14 days from the receipt of the ordered product to: Carbonarm, Via dell'Industria 13 int. 6 - 48015 Montaletto di Cervia (RA) or via email to info@carbonarm.com. The withdrawal notice must specify the intention to cancel the purchase (without the need to justify) and the product(s) for which the customer wishes to exercise the right of withdrawal, attaching a copy of the purchase confirmation documents. Upon receiving the withdrawal notification, an email will be sent to the customer authorizing the return. The customer must pack the product, accessories, and all contents to be returned, using the original box to protect the products from potential damage. The customer must return the products intact within 14 working days from the return authorization to the above address. The right of withdrawal only applies to goods that are intact upon return, according to the provisions of Article 67, paragraph 2, of the Consumer Code. Upon receiving the package containing the returned products, Carbonarm's staff will check the integrity of the goods, accessories, and all original contents. Carbonarm will refund the amounts previously received for the product sale. Shipping and transport costs are borne by the customer. The right of withdrawal cannot be exercised if the products are damaged or used by the customer.
Art. 7 - Applicable Law and Jurisdiction
This contract will be governed by Italian law. Any disputes regarding the validity, interpretation, or execution of this contract will be exclusively resolved by the Court of Rimini.
Art. 8 - Amendments
The terms and conditions contained in this document may be modified by Carbonarm without notice and will be effective from the date of publication on the website www.carbonarm.com.
